1. The rental fees are based on the price list valid at the time the contract is concluded.
2. Special deals may be agreed upon depending on the scope of the rental.
3. The renting party reserves the right to demand a deposit fee and/or payment in advance.
5. The rental period shall commence on the agreed date of readiness for collection or dispatch and shall end when the rental item has been returned in full to the place of issue at the end of the agreed rental period.
5. The rental object can be collected from 1 p.m. on the day before the first day of shooting and must be returned to the place of issue between 8 a.m. and 10 a.m. on the following day of the last day of shooting at the latest. The opening hours published on leuchtturm.li apply.
6. On set-up days on which filming does not take place (prelighting), the rental object will be charged at a factor of 0.5.
7. Saturdays, Sundays and public holidays are generally regarded as normal rental days.
8. If a rental agreement or an order is canceled less than 48 hours (working days) before the agreed start of the rental period, the rental party will be charged 50% of the rental period ordered. The rental relationship shall commence on the agreed collection date.
9. Invoices are issued on the basis of the rental reports/scanned products and are due 30 days after the invoice date.
10. In the event of late payment, the renting party shall be entitled to demand interest on arrears and/or to terminate the rental relationship with immediate effect. In the event of late payment, the renting party also expressly authorizes the renting party to enter any room under the renting party's control in which the rented property is or could be stored. The renting party or its lenders shall not have a right of retention to the rented property.
11. Vehicles are charged in full on travel days. The customer must inform the rental house of travel days in all cases.
12. The costs and risk of transportation, packaging and/or shipping shall in all cases be borne by the customer, even if the rented item is delivered or returned by the rental house or a third party.
13. In the event of transportation or shipment abroad, the customer shall be responsible for the proper completion of all customs formalities. It shall also bear the risk and costs for this.
14. The rented items are insured (excluding breakdown service insurance). The deductible to be borne by the customer is:
CHF 2,000 for vehicle damage and
CHF 2,000 for material damage plus 10% for damage caused by natural forces
15. The rental fee shall remain payable in any case, even if the insuring or renting party repairs or replaces the rented items.
16. The scope of the insurance generally covers the whole of Switzerland. The customer undertakes to clarify the insurance issues for foreign assignments in detail and to take out any necessary additional insurance at its own expense.
17. By taking over the rental object, the customer undertakes all the usual precautions to protect the rental object and to instruct any third parties concerned accordingly. In particular, the doors of transport vehicles must always be kept locked (even during the journey) and rented items must never be left unattended. Where reasonable in terms of the amount of material, rented items must be locked in secure rooms overnight and not left in vehicles.
18 Both the insuring party and the rental house reserve the right to assert financial claims directly against the party causing the damage or the customer for the full extent of the damage in the event of damage caused negligently or by unauthorized or uninstructed persons.
19. If the rental object is exposed to above-average danger due to its use, permission must be obtained from the rental house in advance.
20. The rental house retains all ownership rights to all rented items everywhere and at all times. Any transfer of the leased property or parts thereof to third parties is inadmissible and entitles the lessor to terminate the lease immediately and to repossess the leased property without delay.
21. Assignments by way of security, pledges or other encumbrances of the rental object are invalid vis-à-vis the rental house.
22. In the event of judicial enforcement measures relating to rented equipment, the customer must inform all parties concerned of the ownership situation and notify the rental house immediately. The costs of intervention measures to protect the property as well as damages incurred by the rental house due to the failure of the equipment shall be charged to the customer.
23. The removal or covering of company lettering and logos on the rental object is strictly prohibited.
24. If permanently installed rental equipment is to be reinstalled or stored in other premises by the renting party, written permission must be obtained from the rental house in advance.
25. The customer shall assume unlimited liability for the rented property for the entire rental period.
26. Upon receipt, the customer must inspect the rented property or have it inspected by a specialist. It shall be deemed to have been accepted in perfect condition if defects are not expressly reported upon receipt.
27. All repairs incurred during the rental period shall be at the expense of the customer.
28. The customer shall be fully liable for all damage caused by improper operation or handling of the rented property. Liability on the part of the rental house for direct or indirect damage caused by the use of the rented item is excluded in all cases. Similarly, the rental house cannot accept any liability for direct or indirect damage resulting from malfunctions or breakdowns of the rental item.
29. The customer shall ensure that all persons who may be affected by these terms and conditions are made aware of them and that they are observed at all times.
30. Agreements that deviate from the General Terms and Conditions of Business and Hire must be made in writing.
31. All prices in the price list are to be understood as guide prices and as such are not absolutely binding. Leuchtturm Filmbeleuchtung AG accepts no liability for any errors in the list.
32. Place of jurisdiction is Zurich, Swiss law applies.
